End-User License Agreement (EULA) of DnaMoto

This End-User License Agreement ("EULA") is a legal agreement between you and OneZeroBit

This EULA agreement governs your acquisition and use of our DnaMoto application ("Application") directly from OneZeroBit or indirectly through a OneZeroBit authorized reseller or distributor (a "Reseller").

The User shall read this EULA agreement carefully prior to first start of the DnaMoto application. It provides a license to use the DnaMoto application and contains warranty information and liability disclaimers.
In case the User does not agree with provisions of such documents, the User shall not start and use the Application.

If you not register an user account on DnaMoto application, this EULA agreement will also govern. By clicking "accept" or installing and/or using the DnaMoto application, you are confirming your acceptance of the Application and agreeing to become bound by the terms of this EULA agreement.

If you are entering into this EULA agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity and its affiliates to these terms and conditions. If you do not have such authority or if you do not agree with the terms and conditions of this EULA agreement, do not install or use the Application, and you must not accept this EULA agreement.

This EULA agreement shall apply only to the Application supplied by OneZeroBit herewith regardless of whether other software is referred to or described herein. The terms also apply to any OneZeroBit updates, supplements, Internet-based services, and support services for the Application, unless other terms accompany those items on delivery. If so, those terms apply.

License Grant

OneZeroBit hereby grants you a personal, non-transferable, non-exclusive licence to use the DnaMoto application on your devices in accordance with the terms of this EULA agreement.

You are permitted to load the DnaMoto application (for example a PC, laptop, mobile or tablet) under your control. You are responsible for ensuring your device meets the minimum requirements of the DnaMoto application.

User shall use the DnaMoto application for personal non-commercial purposes. Services related to DnaMoto application use shall not be offered to other Users in order to gain profit. Automated scripts (bots) and other means of interaction with the DnaMoto application without the User are prohibited. Actions to prevent normal operation of the DnaMoto application and special programs with malicious components (viruses) are prohibited.

You are not permitted to:

• Edit, alter, modify, adapt, translate or otherwise change the whole or any part of the Application nor permit the whole or any part of the Application to be combined with or become incorporated in any other software, nor decompile, disassemble or reverse engineer the Application or attempt to do any such things
• Reproduce, copy, distribute, resell or otherwise use the Application for any commercial purpose
• Allow any third party to use the Application on behalf of or for the benefit of any third party, without any explicit authorization of OneZeroBit
• Use the Application in any way which breaches any applicable local, national or international law
• Use the Application for any purpose that OneZeroBit considers is a breach of this EULA agreement

Guarantees and Responsibility

• The User accepts and agrees that the DnaMoto application is provided "as is." OneZeroBit grants no guarantee regarding consequences of DnaMoto application use, DnaMoto application interaction with other software.
• OneZeroBit does not guarantee that the DnaMoto application will suit for specific purposes. OneZeroBit has the right to change DnaMoto application functionality, its interface and/or content with or without User notification at any time. The User accepts and agrees that the result of DnaMoto application use may not meet User's expectations.
• OneZeroBit shall provide technical support for the DnaMoto application and simple communication procedure with Users regarding all issues that may occur during use - in "Help" section and in Application settings.
• OneZeroBit or other rightholders, under no circumstances, shall not be responsible for any indirect, accidental damage (including loss of profit, damaged caused by data loss) suffered due to DnaMoto application use or inability to use, including DnaMoto application failure or any other interruption in DnaMoto application use even if OneZeroBit has warned about or mentioned possibility of such damage.
• The User bears own responsibility for how he/she uses the DnaMoto application, including publication and transfer of information, comments, images and other materials to other Users by means of the DnaMoto application. The User bears own responsibility for observation of third party rights, applicable laws, these Rules, OneZeroBit's rules and/or mandatory instructions published in "Help" section of the DnaMoto application, when using the DnaMoto application.
• If User infringes, OneZeroBit has the right to cancel further services for the User or fully or partially limit such services with or without User notification.
• Registered user can report to OneZeroBit any illegal/offensive/inappropriate content published by other users using the dedicated option "Report abuse" available on multiple DnaMoto application sections (on more options menu) or by writing an email to the team support app at dnamoto.com
• Registered user can stop following (hide) any content (news, paddock girls, ...) published by DnaMoto or third parties, using the option "Stop following" available on multiple DnaMoto application sections (on more options menu)
• Registered user can block any other user registered inside the network. Blocking an user allow hide automatically any content published by blocked user.
• Users blocked or reported by other users may get suspended or removed definitely

Intellectual Property and Ownership

OneZeroBit shall at all times retain ownership of the Application as originally downloaded by you and all subsequent downloads of the Application by you. The Application (and the copyright, and other intellectual property rights of whatever nature in the Application, including any modifications made thereto) are and shall remain the property of OneZeroBit.

• The User agrees that the Application, its interface and content (including but not limited to design elements, text, graphics, images, video, scripts, programs, music, audios and other objects and their compilations related to the Application) are protected with copyright, trademarks, patents and other rights belonging to OneZeroBit or other legitimate rightholders.
• The User shall not copy, change, delete, rework (including any translation or localization), sell, lease, publish, download or otherwise distribute the Application or its components, decompile or otherwise extract the source code of Application components that are the software, and also change Application functionality without prior written consent of OneZeroBit.
• The User shall not delete and/or change any information OneZeroBit has published in the Application, including copyright and personalization symbols.
• This license also covers all updates and/or additional components of the Application that OneZeroBit can provide later.

OneZeroBit reserves the right to grant licences to use the Application to third parties.

Termination

This EULA agreement is effective from the date you first use the Application and shall continue until terminated. You may terminate it at any time upon written notice to OneZeroBit.

It will also terminate immediately if you fail to comply with any term of this EULA agreement. Upon such termination, the licenses granted by this EULA agreement will immediately terminate and you agree to stop all access and use of the Application. The provisions that by their nature continue and survive will survive any termination of this EULA agreement.

Governing Law

This EULA agreement, and any dispute arising out of or in connection with this EULA agreement, shall be governed by and construed in accordance with the laws of Italy.
